Subscription Terms

§1 Subscription tiers

¹ The monthly count applies only to automatic YouTube distribution via the CHOZEN Uploader desktop app. Direct uploads to chozen.io (beats, loops, kits, samples) are not count-limited — they are bounded only by the tier's total storage allowance.
² Storage is the cumulative size of all your hosted content on CHOZEN. Removing content frees up space immediately.

The price shown is the full price you pay. Nothing is added on top at checkout. Features and limits are subject to change. Material changes are communicated per § 6 below.

§2 Contract formation

A subscription contract is concluded directly between you and CHOZEN when you (a) select a tier and review the terms, (b) click the binding-order button ("Subscribe Now" / "zahlungspflichtig bestellen"), and (c) we send an electronic confirmation to your registered email. A summary of terms — price, billing cycle, renewal, cancellation — is shown before the button.

§3 Billing & payment

• Processed by Stripe, Inc.
• Billing cycles: monthly (same calendar day each month) or annual (anniversary of start date). Annual subscriptions may carry a discount.
• Accepted methods: credit / debit card (Visa, Mastercard, Amex), SEPA Direct Debit (EEA), and other Stripe-supported methods.
• Failed payment: you are notified within 24 hours; a 7-day grace period; Stripe retries up to 3 times. If payment remains unsuccessful, the subscription is downgraded to Free (content is not deleted but is subject to Free-tier limits — see § 10).

§4 Auto-renewal

• All paid subscriptions auto-renew at the end of each billing cycle unless cancelled.
• Auto-renewal is disclosed in the purchase flow, in the confirmation email, and in Account Settings.
• A renewal reminder is sent at least 3 days before the next billing date with the renewal date, amount, and cancellation instructions.

§5 Cancellation

• Cancel anytime — takes effect at the end of the current billing period; access to paid features continues until then.
• No partial refunds for unused portions of a billing period, unless mandatory consumer law requires otherwise.
• Cancel with the cancellation button “Verträge hier kündigen” in the footer of every page, which leads to chozen.io/kuendigen and works without logging in (§ 312k BGB); in your dashboard under Subscription → Cancel Subscription; in the billing portal (“Zahlungsmethode & Rechnungen”); or by email to support@chozen.io.
• You may cancel ordinarily (at the end of a billing period, the earliest possible or a later one you name) or for good cause (§ 314 BGB, see § 8).
• You receive a cancellation confirmation by email right away, with the content of your cancellation, the date and time we received it, the date your contract ends, and what happens to your content (see § 10).
• If you use the form without logging in, the confirmation goes to the email address of your account and contains a button “Kündigung bestätigen”. We carry out the cancellation once you click it, so nobody else can end your plan by typing your address. It still counts from the moment it reached us. Logged in, no extra step is needed.

§6 Price changes

• Notice ≥ 30 days in advance via email.
• Notification includes current and new price, effective date, right to cancel, and cancellation instructions.
• If you do not cancel before the effective date, the new price applies from the next billing cycle.
• Price decreases may be applied immediately without advance notice.
• Grandfathering policy: existing subscribers are notified at least 30 days before any price increase and may cancel before the new price takes effect. No additional grandfathering beyond this notice period applies unless separately agreed in writing.

§7 Premium Codes

CHOZEN may issue Premium Codes that grant temporary or permanent access to paid features (competitions, achievements, promotions, referrals). Codes are one-time, non-transferable, and have an expiry date. Codes cannot be exchanged for cash and cannot be combined with other promotional offers unless explicitly stated. Misuse may result in revocation.

§8 Consumer right of withdrawal

If you are a consumer (§ 13 BGB), you can withdraw from a subscription contract. Below is the statutory withdrawal notice. Your subscription confirmation email contains the same notice and form.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

Haben Sie verlangt, dass die Dienstleistungen während der Widerrufsfrist beginnen sollen, so haben Sie uns einen angemessenen Betrag zu zahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich dieses Vertrags unterrichten, bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.

Withdrawal notice

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (CHOZEN, Thomas Ehresmann, Reichenberger Str. 25, 36039 Fulda, Germany, email: withdrawal@chozen.io) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Immediate start

Before subscribing, you agree that your plan starts right away. The confirmation email quotes this consent word for word, with its date and time:

"Ich stimme ausdrücklich zu, dass mit der Erbringung der Abonnement-Leistung sofort begonnen wird, und nehme zur Kenntnis, dass ich mein Widerrufsrecht verliere, sobald die Leistung vollständig erbracht ist."

(English: "I expressly consent to the immediate provision of the subscription service and acknowledge that I lose my right of withdrawal once the service has been fully provided.")

Because your plan starts right away, if you withdraw you only pay for the time up to your withdrawal. We refund the rest.

Both parties retain the right to terminate for extraordinary cause (§ 314 BGB) — material breach not remedied within a reasonable period; insolvency or business closure; or fundamental service changes that make the agreed performance impossible or substantially different from what was contracted for (e.g. discontinuation of the marketplace, removal of upload functionality, loss of EU-region availability, or removal of the FL Ranked feature for users who subscribed primarily for ranked play).

§9 Pro-rata refunds & service credits

• If CHOZEN terminates your subscription without cause, you receive a pro-rata refund for unused days.
• If your subscription is terminated for your violation of these terms, no refund is issued.
• Platform-wide outages > 72 consecutive hours: service credit equivalent to the outage duration, applied to the next billing cycle. Credits cannot be exchanged for cash and expire after 12 months.

§10 Tier-downgrade effects

• Content exceeding the new tier's limits is not deleted; it is placed in a read-only state.
• You may continue to view, manage, and download existing content; you may not upload new content until you are within the lower tier's limits.
• 30-day grace period to reduce content to the new limits (downloads / archive); you may also upgrade to restore full access.
• Tier-specific features (advanced analytics, priority support, etc.) become unavailable immediately upon the subscription end date.

§11 Free tier

• Available to all registered users at no charge; no payment information required.
• CHOZEN reserves the right to modify, limit, or expand Free-tier features; material reductions are communicated with reasonable notice.
• Same Terms of Service and Community Guidelines apply.
• Advertising: CHOZEN does not currently serve third-party advertising to Free-tier users. If this changes, affected users will be notified at least 30 days in advance, the change will be reflected in this section and in the Privacy Policy, and fresh consent will be obtained for any profiling-based ad targeting.
• If CHOZEN ever discontinues the Free tier entirely, ≥ 30 days advance notice and content-export opportunity.

§12 Governing law & disputes

Governed by the laws of the Federal Republic of Germany; CISG excluded. EU consumers retain mandatory protections of the law of their habitual residence. Consumer-jurisdiction rules apply for consumer disputes; otherwise the courts of Berlin have exclusive jurisdiction. EU ODR platform: ec.europa.eu/consumers/odr/. CHOZEN is not obligated to participate in proceedings before a Verbraucherschlichtungsstelle unless required by law. Parties shall attempt amicable resolution before legal proceedings; written notice triggers a 30-day response window.
